Workplace Harassment Definition

Workplace harassment has serious consequences and its effects can be more psychological than physical. Harassment can occur between the victim and the employer as well as a coworker. It is defined in section 55A (1) of the Occupational Health, Safety, and Welfare Act 1986:

Relevant Legislation for workplace Harassment

Harassment at a workplace in highly inappropriate and should never be tolerated and any circumstances. It is unacceptable under the Occupational Health, Safety and Welfare Act 1986, (the OHS&W Act) and the Occupational Health, Safety and Welfare Regulations 1995. Even a single incident of unreasonable behavior should not be ignored as it can lead to harassment. Workplace harassment even when not intended can have serious issues. A decided case in NSW provided an employee with a $500,000.00 payment for harassment by her manager over a period of 2 years.

The Effects of Workplace Harassment

Workplace harassment may also result in high staff turnover, low morale, and insufficient productivity. Some of the other effects of harassment are unwarranted stress, ill health, inability to make a decision, depression, physical injury etc.

Examples of Workplace Harassment

Some examples of what may constitute harassment are reproaching of staff, targeting of particular staff, manipulating staff’s reputation by insults and gossip, and insinuation, putting someone down and requesting performance of unreasonable duties which are unreasonable. It is also commended that harassment may now and again include harassment or discrimination where a man preposterously singles out an individual trademark, for example, race, sex, pregnancy, conjugal status, religious convictions, handicap or age which causes another to feel humiliated, mortified, irritated or scared. Discrimination, as well as harassment, can have serious consequences.
